SmarteBuyer.com reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your use of the SmarteBuyer.com Web site following any such change constitutes your unconditional agreement to follow and be bound by the Terms and Conditions as changed. For this reason, we encourage you to review these Terms and Conditions whenever you use this Web site.

Tampering with the site, misrepresenting the identity of a user, using buying agents or conducting fraudulent activities on the site are prohibited.

Pricing or Typographical Errors
Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and SmarteBuyer reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, SmarteBuyer will issue a credit to your credit card account in the amount of the charge. Individual bank policies will dictate when this amount is credited to your account. If you are not fully satisfied with your purchase, you may return it in accordance with SmarteBuyer’s return policy.
 
Colors
We have made every effort to display as accurately as possible the colors of our products that appear on the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.
 
Validating Your Order
After you place an order using our shopping cart, we will check the information you give us for validity, by verifying your method of payment or shipping address. We reserve the right to reject any order you place with us, and/or to limit quantities on any order, without giving any reason. If we reject your order, we will attempt to notify you using the e-mail address you have given us with the order.

Your credit or debit card will normally not be charged if we reject an order, but we will process a refund if the charge has been made against your card.
 
Order Acceptance/Confirmation
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. The SmarteBuyer web site reserves the right at any time after receipt of your order to accept or decline your order for any reason.
 
Shipping
All orders placed on this site are subject to product availability. Please review the status of your shipping, and track the details at your delivery company, such as UPS.

Note:The services of UPS 1 Day PM, UPS 2 Day, and UPS 3 Day are not applicable if your orders are placed after 4:00PM EST.
 
Customs, Duties and Confiscated International Shipments
We are not able to lower the value of a shipment for customs purposes. We are not responsible for customs fees. If your customs and /or local government confiscates your order, SmarteBuyer.com will in no way be held responsible. You are, however, responsible for the costs of the items, shipping and any return shipping charges that are incurred.
 
Lost, Damaged and Returned Shipments
  • Damaged during the delivery process: Please contact your delivery company to claim the damage. And please beware that you may check the package when you receiving for the next order, if damaged, please claim to the delivery person immediately.

  • Lost orders: If your items during delivery, please contact the delivery company you selected.
  • Returned due to customer neglects, such didn't pick up after delivery company left pick-up note; or missed when vacation, customer will need to respond another handling fee to resend or cancel order.

    Cancel Order
    Cancel Order has to be made before 5:00pm EST at same purchasing date. Cancel for the orders made between 5:00pm - 11:59pm EST and Sundays or public holidays will NOT take effect until next business day. To cancel the orders, please send email to: support@smartebuyer.com, cut off time will be base on support@smartebuyer.com mailbox timer. Due to the volume of packages we ship each day, it is impossible to locate and make changes to a single package once it has entered the shipping process, otherwise, 30% restocking fee will be charged as return product(s).
    Usually the order(s) will be shipped out at the same date you purchased.
     
    Duplicated Order
    Duplicated Order will be nonrefundable by any customer mistake, such as submit twice, wrong shipping address and refresh transaction page or item(s) ordered before. Any returned duplicated order(s) will have 30% restocking fee as other return product(s).
     
    Defective Items Return Policies
    In the event that an item purchased from SmarteBuyer.com is defective, we will exchange the item under the manufacturer's warranty for a copy of the same title, provided the title is still currently available in our regular inventory. If the title is no longer available, or is no longer covered by the manufacturer's warranty, this warranty is void. Proof of purchase is mandatory, and items will be exchanged only. No refunds!
    Note: The customer is responsible for all shipping charges for the exchanged/returned items.
    This warranty does NOT cover the following:
  • Physical damage from shipping (see damage claims) handling, abuse, or operation of defective or maladjusted equipment.

  • Any item not in pristine "like new" condition.

  • Items that show excessive wear beyond the normal handling required to detect a defect including, but is not limited to, marks with stickers, ink, or any other non-removable materials.

  • 'Did not like' or 'poor transfer (video) quality' are not acceptable defects.
  • Some covers may have slight damage like a bent cover. Replacement covers are NOT available.
  •  
    Unfortunately, certain models of DVD players are not able to play certain VCDs and DVDs. SmarteBuyer.com cannot be held responsible for discs that cannot be played on certain systems. However, SmarteBuyer.com will exchange the incompatible title with another title provided the warranty conditions are met.
     
    Defective exchanges must be accompanied by the following information:
  • The exact location of the defect.

  • The nature of the defect.

    Returned titles must be in their original factory packaging. Enclose with each returned title the following information:
  • Your name, address and telephone number.

  • A copy of your SmarteBuyer.com receipt that from your personal account or your Order number as proof of purchase.

  • The reason why you are returning the title.
  • Before you returning the items to us, please email us at: return@smartebuyer.com. When returning items to us, use a sturdy carton or bubble bag that will prevent damage to the items.

    Non-defective Items Return Policies
    Only sealed, unopened titles will be accepted for credit, exchange, or refund within 14 days of purchase. Items must be in "like new" condition in order for us to issue credit. Any item not meeting these conditions will be returned to you and no credit issued. Credit will not be issued for shipping charges and you will be charged a shipping charge for exchanges. A copy of your original purchase receipt or Order Number is required.
    Note: The customer is responsible for all shipping charges for the exchanged/returned items.
    Returned titles must be in their original factory packaging. Enclose with each returned title the following information:
  • Your name, address and telephone number.

  • A copy of your SmarteBuyer.com receipt or Order Number as proof of purchase.

  • The reason why you are returning the title.

    A 30% restocking fee will be charged on returns or exchanges unopened product(s), unless defective.
    Opened product(s) will be nonrefundable.
    This return policy may vary slightly.
    We will do our best to process the return quickly. Please allow 5 - 14 days for processing. Refunds will be credited to the original purchasing credit card account number only.
